That's Just Wrong: Filing Taxes Without W-2 Form

All That's Just Wrong

29 days and counting - that's how much time we have until tax day. But one Ft. Lauderdale woman was looking forward to it because she should be getting a refund. Trouble is, she says her old boss won't mail her W-2 form. And now, she's telling 7's Craig Stevens "That's Just Wrong".

WSVN -- Holly Hendra's one of the lucky ones. She's supposed to be getting a refund this tax season.

Holly Hendra: "You get a couple of thousand dollars back, woo hoo, you can put it in your 401k, you can put it in your savings bank, you can take some money and go to the keys for the weekend."

And she could use the r-and-r. You see, as a dental assistant, holly knows getting people to cooperate can be difficult.

But she never thought her former employer would be one of them.

Holly Hendra: This other dentist that i worked for the majority of the year, seven months, full time, will not send me my W-2."

Holly's tried calling and calling... But now, she says that's just wrong.

Holly Hendra: "I just want my W-2, that's all i want, just send me my W-2. Let me submit my taxes and stop worrying about this."

But for Holly, the worrying and the work has only begun. By law, W-2's are supposed to be mailed out by january 31st. If you still don't have one, the irs says you should make every attempt to get it from your employer. If that doesn't work, you can call the agency's hotline.

Mike Dobzinski: "We will send them a letter reminding them of their obligation to provide it."

If that still doesn't work, you'll need to use old pay stubs or this form to guesstimate earnings and deductions.

Holly Hendra: "We can figure out according to what i made per hour, what taxes should have been deducted from my paycheck, so it's going to be tough."

Tough but not impossible. Holly knows it will take some work for her to smile. We tried contacting her old boss, but he hasn't returned our call. Fortunately with right paperwork, she can get her refund even without receiving the W-2.

Holly Hendra: "It's very nerve racking, i'm very nervous about this to owe. I want money back. I deserve it."
