MIAMI (WSVN) -- A retired Broward Sheriff's Office deputy appeared in court Tuesday morning on a domestic battery charge.

Maury Hernandez is accused of grabbing his wife by the neck during an argument over their 15-month-old son. On Tuesday, a judge granted the 33-year-old limited visitation rights.

Hernandez first made headlines in 2007 after he was shot in the head while on duty during a traffic stop in Pembroke Park. He spent weeks in a coma.

In January 2012, Hernandez shot a homeless man in Miami Lakes, who he claims was harassing his family outside a Haagen-Dazs ice cream shop. The victim survived and Hernandez was not charged.
