Police said teen's death accidental

HOLLYWOOD, Fla. (WSVN) -- Hollywood Police department said the fatal shooting of a 13-year-old boy was unintentional, and no one has been charged at this time.
On Wednesday, at around 2 p.m., Hollywood Police responded to a report of a gunshot at 1300 N 73rd Way. Upon arrival, officers discovered 13-year-old Daniel Torres in the rear of the residence with a gunshot wound to the head.
Torres was transported to Memorial Regional Hospital in Hollywood, where he later died from his injuries.
A next door neighbor said she witnessed the grief of the 14-year-old, who is accused of accidentally shooting Daniel. "He was hysterical and screaming, 'Daniel! Daniel!' He was frantic. I heard him screaming before I got to see what happened," said the unidentified neighbor. "If you would have saw the agony in his face, you would have definitely know that this was an accident."
Both teens attend Apollo Middle School and are reportedly friends. "He was a polite kid. He was kind to me. We used to joke around," said one fellow classmate.
Hollywood Police have determined the shooting was an accident, but charges may be filed against someone at the 14-year-old's home. "The gun was accessible. It was inside the residence and how it was secured, I don't know," said Hollywood Police Lieutenant Manny Marino.
Officials recovered a 9 mm handgun on the scene and they said it belongs to the homeowner. In Florida it is illegal to leave a loaded gun where children can easily get to it.
Daniel's mother returned home briefly, but declined to comment on the shooting that took her son's life.
Friends and relatives continue to place cards and candles near Daniel's home.
Police continue to investigate.
