Trial of man accused of killing couple during carjacking begins

MIAMI (WSVN) -- Opening statements have begun in the murder case of a South Florida man accused of shooting and killing a couple during a gas station carjacking, back in 2011.

As the trial began Wednesday morning, graphic surveillance video from the scene became the centerpiece in the prosecution's case against 18-year-old Eric Ellington. Prosecutors said the man with the gun seen in the video is Ellington.

They claim he is the man who violently gunned down Julian Soler. According to court records, two other men were charged in the crime, Wayne Williams and Dillon McFarlane. One of those men stands accused of shooting dead Soler's girlfriend, Kennia Duran. According to reports, the couple had stopped at the Mobile gas station located at 16691 N.W. 57th Ave. in Miami Gardens to put gas after a night of celebrating Soler's 23rd birthday.

The surveillance video from the gas station, when the double murders took place on July 25, was played for the jurors in its entirety. In the video, Ellington is seen pointing the gun at the couple. "As they talk, and as he goes away, the man with Julian shoots him, and he falls to the ground," said Assistant State Attorney Alejandra Lopez.

Once the first shot is fired Soler is seen falling to the ground. "As he continues to raise his hands in surrender that man shoots him not once, not twice, but eight times as he lies on that ground, helpless," said Lopez in her opening statement to jurors.

Duran is then shot by Ellington's accomplice. "As Kenya is screaming, is screaming, she pokes her head up trying to get up."

The men then fled the scene in a stolen Nissan Pathfire, according to reports.

In the defense's opening, they claimed there was reasonable doubt and there are holes in the prosecution's case. "Watch the video, it is terrible, it is emotional. It does not give you clues as to who the perpetrators are. It is grainy," said public defender Herbert Smith.

The prosecutors used the security footage and fingerprint evidence to place Ellington at the scene. As well as a taped interview with Ellington's mom, Erica Love. The video is of when detectives showed Love the surveillance video of the crime. "You will also hear that when Erica Love is shown the video, she identifies one person, 'That's my baby,' as she sees the first man come out of that green Pathfinder Nissan."

The majority of testimony heard after opening statements mostly revolved after another carjacking that had occurred hours before the murders.

There will also be a taped confession from Ellington that will be played at some point throughout the trial.

Testimony will continue Thursday morning.

Ellington faces two counts of first degree murder and armed carjacking.
