Bieber scheduled to return to Miami for civil case

NORTHEAST MIAMI-DADE, Fla. (WSVN) -- Justin Bieber is scheduled to return to South Florida for questioning in a civil case, not his recent arrest.

He is scheduled to be deposed in a civil lawsuit at 10 a.m. Thursday in Downtown Miami, according to court records in a case that took place outside of a recording studio in June of 2013.

According to investigators, the victim, Jeffery Binion, was standing on the roadway outside of The Hit Factory recording studio and began taking pictures of Bieber when four males approached him.

"Some security guards for Justin Bieber ... they assaulted me, took my camera, I mean took my camera and were going to smash it ... they took my memory card out of the camera," Binion said during a 911 call.

One of the subjects, identified as Hugo Hesny, grabbed Binion by the neck and pushed him away. The other subject then took Binion's camera, removed the memory card and returned the camera.

"The guy just choked me, he was trying to take my stuff. They first took my camera and made me delete the pictures. I deleted them, and they took the memory card out of my camera, which is like a $100 card."

Investigators are looking into the incident to determine any additional charges.

According to Binion, he does not believe Bieber will appear. He was scheduled to be deposed on Jan 23. Binion's attorney flew to Los Angeles but Bieber did not arrive, due to his arrest on Miami Beach.

"We are also seeking punitive damages against him to send a message to him and to deter him from this future conduct because, just in the past few months, he's been doing this often and getting away with it, and he's not going to get away with it this time," Binion's attorney Russell S. Adler said, last June.

Hesny was arrested last week in Atlanta for attacking a person during a security detail regarding Bieber.

Hesny was also arrested last December in Aventura at the Aventura Mall. According to the arrest affidavit, there was a large crowd in front of the AMC Movie Theater. As security tried to disperse the crowd, Hesny refused to leave and physically pushed them repeatedly. He was later arrested.
