Mother testifies in son's alleged school sex assault case

MIAMI (WSVN) -- A South Florida mother took the stand in the civil case against the charter school where she said her young son was molested multiple times.

The mother, who was not identified, was emotional at times while she graphically described what she said her son told her that another child made him do. "He told me, 'Mom, it was not only the bus incident that is the reason why I tried to harm myself," said the victim's mother in court.

The child's mom said her son was forced to perform oral sex on an 11-year-old student in a school van and bathroom at Downtown Miami Charter School in 2011. "No, I never thought that he made that up. Just by talking to him and looking at his demeanor, I knew that he was serious," said the mother.

She said, since the horrible incident, her son has transferred to another school but has been emotionally traumatized. "Now, it just seems like his mind races, and he really can't gather his thoughts. He can't really keep up in class. He can't really focus on the homework," she said. "He was just going to the bathroom and just freeze."

The mother said she complained about the alleged incident but said the school did nothing. She is seeking $25 million from Charter School USA. "She just told me, 'All children are safe at Downtown Miami Charter,' and me having these concerns I should not worry," said the mom.

The school's principal and driver testified in court last week. The driver said he never noticed anything unusual. The principal said she did all she could when she was made aware of the allegations. "If a student forced another student to give them oral sex, that's against the law," said principal Rebecca Dinda.

"He was like, 'It's embarrassing. I don't want to talk about it. I would rather harm myself. I would rather kill myself before I talk about it,'" said the mother with tears in her eyes.

The trial will continue on Tuesday morning. A therapist, experts and teachers are expected to take the stand.
