Mother accused of kidnapping her children making plea deal

MIAMI (WSVN) -- A mother is in court Tuesday to cop a plea for kidnapping her own children and fleeing the state.

Carrie Weingarth, accused of taking her three sons without permission, will not be going to jail. She took a plea of no contest and will have to do two years of probation, take parenting classes along with drug and mental evaluations.

Weingarth stands accused of taking her three sons from South Florida last February. She took 12-year-old Erin Pena out of school without permission. She already had his two younger brothers, 8-year-old Steven and 7-year-old Derrick with her. They were all found almost a week later, about 2,600 miles away, in Barstow, California. All three children were found unharmed.

Weingarth's attorney, Rick Yabor explained that this case is a custody battle. "This is something that's going to be addressed now in family court, which in my opinion is where it should have been in the first place, a family court case," said Yabor. "She has issues she needs to deal with in family court, but we got this out of the criminal court arena, and now we're going to focus on getting her kids back."

The case has been in the court system since Feb. 20, but it will now play out in family court.
